Warehousemans Legal Liability Policy

The warehouse legal liability policy maintained by MTC provides coverage for our legal liability as a warehouseman, for damage to personal property of others while in storage at our warehouse locations. This policy is designed to respond when MTC, as a warehouse operator, fails to exercise reasonable care in the handling and storage of our customer's goods that results in loss of, or damage to, those goods. MTC's liability is limited to loss or damage to the depositor's goods attributable to our negligence.

The Uniform Commercial Code specifies the duty of care imposed upon the warehouseman as follows: A warehouseman is liable for damages for loss of or injury to the goods caused by its failure to exercise such care in regard to them as a reasonably careful man would exercise under like circumstances but unless otherwise agreed he is not liability for damages which could not have been avoided by the exercise of such care.
